Before and After Analysis: An Application of Structural Break Testing to the Determination of Economic Damages
Abstract
Before-and-after analysis is a highly reliable method for determining economic damages and providing support of causation claims in business interruption cases that has been accepted by courts in nearly every jurisdiction, but rudimentary methods, e.g. graphical analysis, simple correlation analysis, etcetera, are not foolproof.
